Collaborative law: towards the establishment of an approval procedure?
Collaborative law is an alternative method of dispute resolution: the parties, assisted by their lawyers trained in collaborative law, engage in a negotiation process aimed at reaching an amicable agreement.
A bill was introduced in Parliament on 13 December 2024 and is currently being examined in committee.
The text aims to establish a simplified approval procedure for agreements concluded in this context, inspired by the procedure provided for in Article 1733 of the Judicial Code for mediation.
This approval by the courts would give such agreements a real enforceability.
